Comprehensive Release Form for Dante Documentary Participants
1. Acknowledgment of Voluntary Participation and Assumption of Risks
Illicit Drug Use: The participant acknowledges and voluntarily assumes all legal, personal, and social risks associated with any portrayal of psychedelic use in the documentary. The participant waives any claims against Sffr Films, LLC, including but not limited to criminal, civil, and reputational implications.
Mental Health and Physical Stability: The participant confirms they are of sound mind, physically and mentally capable, and willing to undertake any risks inherent to the documentary. They waive all future claims for any adverse effects post-production, including mental health or physical strain.
2. Rights to Edit, Adapt, and Portrayal Waiver
Absolute Editing Discretion: The participant irrevocably grants Sffr Films, LLC full editorial discretion over the footage, including any adaptations, edits, or portrayals. They waive all claims for misrepresentation, defamation, or right of publicity.
Non-Blurring of Third Parties: The participant agrees that Sffr Films, LLC is not obligated to anonymize or blur incidental third parties, releasing Sffr Films, LLC from liability for third-party claims.
3. Waiver of Defamation, Right to Privacy, and Non-Liability for Health and Safety
Defamation and Privacy Waiver: The participant waives all claims related to defamation, privacy, right of publicity, or other personal rights, releasing Sffr Films, LLC from liability for any portrayal that may result.
Non-Liability for Physical and Mental Health Risks: The participant assumes all risks associated with physical exertion and mental impact, releasing Sffr Films, LLC, from claims related to injury, health complications, or adverse outcomes from participation.
4. Global Rights to Use Audio, Video, and Likeness in All Media
Worldwide, Perpetual Usage Rights: The participant grants Sffr Films, LLC unrestricted, irrevocable, and perpetual rights to use their image, likeness, voice, and recorded interactions across all media, globally, without limitation.
Additional Media Projects: The participant agrees that their image, story, or likeness may appear in promotional materials or future productions without further consent or compensation.
5. Confidentiality and Non-Disclosure Agreement (NDA)
Confidentiality Requirement: Participants agree to keep confidential all details regarding the documentary’s content, plot, and production process, and will not disclose them to any third party until official release.
Liability for Breach: A breach of this confidentiality clause may result in liability for damages to Sffr Films, LLC, and potential legal action.
6. Moral Turpitude and Conduct Clause
Right to Edit or Exclude: Sffr Films, LLC reserves the right to edit or exclude participants if any past or future actions harm the reputation of the documentary. This clause applies to significant criminal behavior or public actions deemed detrimental to the project’s image.
7. Media and Marketing Agreement
Use of Likeness for Marketing: The participant authorizes Sffr Films, LLC to use their likeness, voice, and participation details for documentary marketing, including promotional content, social media, press releases, and other advertising mediums.
8. Waiver for Use of Unaltered Opinions and Statements
Consent for Unaltered Statements: The participant consents to allow Sffr Films, LLC to use all recorded statements or opinions in their original form, without editing for neutrality. The participant waives claims against editorial choices regarding these statements.
9. Acknowledgment of Pre-Release Preview Prohibitions
No Guarantee of Pre-Release Preview: Sffr Films, LLC is under no obligation to provide a pre-release preview of the documentary. Participants acknowledge that they will not influence the final product or request changes based on personal preferences.
10. Future Rights and Additional Compensation
Acknowledgment of Future Rights and Profit Sharing: The participant acknowledges that any additional compensation, if offered, will be solely at the discretion of Sffr Films, LLC and is not guaranteed. The participant further understands that Sffr Films, LLC holds exclusive rights to any future profits or derivative works created from the documentary, without obligation to share any revenue with participants unless otherwise negotiated after the completion of the film, based on the documentary’s financial or critical success.
11. Preliminary Agreement with Binding Final Release
Binding Nature Pending Legal Review: This preliminary release is binding and enforceable, subject to a final version by a licensed attorney. Participation is conditioned upon signing the final version without reservation.
12. Irrevocability of Consent
No Revocation of Consent: The participant waives the right to revoke consent indefinitely, for all media usages and adaptations by Sffr Films, LLC.
13. Exclusive Jurisdiction and Legal Dispute Resolution
Jurisdiction: All disputes shall be governed exclusively by the jurisdiction of Sffr Films, LLC’s home state, waiving the participant's right to dispute this jurisdiction or bring claims in any other location.
